Itemity Terms of Use & Privacy

Effective date: November 1, 2026

Privacy Policy only

Agreement and use of Itemity

Itemity is provided by 852 Technologies LLC ("we", "us", "our"). These Terms of Use and Privacy Notice ("Terms") form a binding agreement between you and us and govern your download, installation and use of Itemity, including its content, features and updates (the "App").

By downloading, installing, accessing or using the App, you confirm that you have read, understood and agree to these Terms. If you do not agree, do not install or use the App and uninstall it from your devices.

You are responsible for your use of the App and for all information you enter, import, photograph, store, export or share through it. If you record information about other people, such as the names or photos of household members, you are responsible for having the right to do so.

Eligibility

You may use the App only if you are at least 13 years old and have legal capacity to enter into this agreement. If you are under the age of legal majority where you live, you may use the App only with the consent and supervision of a parent or legal guardian who agrees to these Terms.

Limited licence

Subject to these Terms and applicable app-store rules, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the App on devices you own or control, solely for your personal, non-commercial inventory-management purposes.

The App is licensed, not sold. Except for this limited licence, no right, title or interest in the App or our intellectual property is transferred to you.

Acceptable use

You must not use the App unlawfully; infringe another person's rights; introduce malicious code; interfere with or bypass security or technical limits; misuse third-party lookup services; or use automated means to overload, scrape or extract data from the App or those services.

You must not copy, modify, distribute, sell, rent, lease, sublicense, reverse engineer, decompile or attempt to derive the source code of the App, except to the limited extent that applicable law expressly permits and does not allow that restriction to be waived.

Expiry dates, health and product safety

Expiry dates, "expiring soon" alerts, waste forecasts, reorder advice, shopping suggestions and all other notifications are reminders based only on information you or third parties provide. They may be incomplete, delayed or wrong.

The App is not a medical, pharmaceutical, food-safety, product-safety or recall-monitoring service and is not professional advice. It does not assess storage conditions, contamination, allergens, product defects, label changes or official recalls.

Never rely on the App to decide whether food, medicine or any other product is safe, effective or suitable to use. Inspect the product and its current label, follow official safety and recall information, and obtain qualified professional advice where appropriate.

Accuracy, estimates and user responsibility

Product details obtained by barcode lookup come from independent third-party databases and may be inaccurate, incomplete, duplicated or out of date. You must check all details before saving or relying on them.

Reports, prices, quantities, consumption rates, forecasts and recommendations are estimates calculated from available entries. We do not verify your entries or guarantee any result. You remain responsible for purchasing, storage, stock, budgeting and safety decisions.

Barcode lookup services

Barcode lookup uses independent services, currently Open Food Facts and its sister databases, and UPCitemdb. We do not own, operate or control them and do not guarantee their content, legality, availability, response time, limits, security or continued operation.

Those services may change, restrict, suspend or stop service without notice. Your use of them is subject to their own terms, licences and privacy policies. Open Food Facts data is made available under the Open Database License (ODbL).

Links, names or access to third-party products or services do not mean that we endorse, sponsor or accept responsibility for them. To the fullest extent permitted by law, your dealings with third parties are between you and that third party.

Itemity Pro, purchases and free trial

Some features ("Itemity Pro features") require a purchase. Each is a one-time purchase of a licence to use that feature in the App; it is not a subscription and does not renew. The "Version 1 Bundle" is a one-time purchase covering the Itemity Pro features listed for it in the App; it does not include Itemity Pro features we add in later versions, which may be sold separately or in a later bundle. Prices are shown in the App and by the app store before you buy, in your local currency, and may include tax.

Purchases are made and paid for through Google Play or the Apple App Store under their terms, using the store account you are signed in to. We do not receive or store your payment details. Refunds, if any, are handled by the store under its refund policy and applicable law. We do not provide refunds, credits or other compensation ourselves, except where mandatory law requires it. To restore purchases on a new or reset device, use Restore Purchases in the App while signed in to the same store account.

For a limited period after you first install the App (currently 10 days), all Itemity Pro features are available free of charge as a trial. When the trial ends, Itemity Pro features you have not purchased are no longer available; data you created with them stays on your device. We may offer introductory or limited-time prices, shown in the App together with the period they apply to. We may change prices for future purchases; a change does not affect a purchase already made.

A purchased feature remains available for as long as we offer and support the App on your platform. If we have to remove or materially change a purchased feature, we will act reasonably and provide any remedy required by applicable law or the store's rules.

Privacy and device data

The current version of Itemity has no server operated by 852 Technologies LLC and no advertising service. Your inventory, photos, settings and optional device-local login profile (display name, username, a hashed password, an authenticator secret, a hashed date of birth used only to recover the authenticator, an optional recovery email address and an optional profile picture) are stored on your device, not in an online account with us. Some data is processed by third-party services only as described below. The database that holds your records (items, purchases, usage, categories, locations, people and settings) is encrypted using a random key that the App creates on your device and keeps in its secure storage. Photos and icons are stored as ordinary files in the App's private storage and are not encrypted by the App. If you add a home-screen widget, a short summary of your inventory (for example the names of items that are expiring, your shopping list and reorder suggestions) is kept unencrypted in the App's private storage so the widget can show it; it is visible on your home screen whenever the widget is, even if the App's login is turned on.

When you request a barcode lookup, the barcode number is sent to the third-party lookup services described above. Like other internet requests, those services also receive technical request data such as your IP address and may process it under their own privacy policies. No other inventory fields are intentionally included in the lookup request. When you choose a 3D icon that isn't built into the App, it is downloaded once from a public hosting service for an open-source icon library, which receives technical request data such as your IP address. When a lookup finds a product photo, the App may download it from the address the service gave, which can be a server of Open Food Facts or of a retailer or other website listed by UPCitemdb; that server receives technical request data such as your IP address.

To sell and restore Itemity Pro features, the App uses Google Play or Apple App Store billing and an independent purchase-management provider. The App sends that provider a random identifier created for this installation of the App (not your name or email address), purchase and restore records, and technical data such as the app version, platform, store country and ordinary network request data (such as your IP address). The provider and the store process this data under their own privacy terms to verify purchases and tell the App which features you own. Your inventory data is not sent.

The App uses an independent app-update and diagnostics provider to deliver app updates and to measure performance. When the App starts, it checks the provider's servers for updates, sending technical data such as the app version, platform and a random identifier created for this installation. The App also sends the provider anonymous performance and crash reports: start-up and screen-drawing times, device model and operating-system version, battery, temperature and network state, a summary of the network requests made during start-up (such as which servers were contacted), and details of errors and crashes, tagged with that random installation identifier. These reports do not include your inventory, photos or login details, and are used only to find and fix problems. The provider processes this data under its own privacy terms.

The App accesses the camera or photo library only when you choose a feature that needs it, such as scanning a barcode or adding a photo, and subject to your device permissions. Photos remain device-local unless you choose to export, share or back them up.

When you create or share a backup, you choose the destination. The recipient or storage provider you select—including a cloud-storage, file or email provider—may receive the backup and related technical data under its own terms and privacy policy.

If you choose to send a problem report, your email app opens with the report so that you can review it before sending. It contains technical information—the app version, device model and operating system, app language, this installation's support ID, app settings, counts of stored records, and recent error details (including the screens and actions just before the newest error)—but not item names, photos or login details.

If you contact us, we receive the contact details and message content you provide. We may use and retain them as reasonably necessary to respond, provide support, protect legal rights, prevent abuse and comply with law. We do not sell personal information.

About > Share Feedback opens our website in your browser; the website is not part of the App. It is delivered by website hosting and content-delivery providers (including for the fonts it displays), which receive technical request data such as your IP address. It also has an optional feedback form run by an independent form provider, which receives what you submit, and a cookie-free visit counter run by an independent analytics provider. Each processes data under its own privacy terms, and the Privacy Policy on our website gives more detail.

Because we do not possess your device-local App data, you normally access, correct or delete it using the App or your device, including by clearing App data or uninstalling. Purchase records held by our purchase-management provider can be deleted on request; please include the support ID shown in About > Application Info. Applicable law may give you additional rights (see "Your privacy rights" below). For privacy questions or requests concerning information we may hold, contact support@852technologies.com

Your data and backups

You are solely responsible for maintaining suitable backups and for checking that they can be restored. Uninstalling the App, clearing its data, device failure, loss, theft, operating-system changes or App errors may permanently erase data that is not recoverable from a valid backup.

The App keeps your inventory only on your device. Android's automatic backup and cloud-backup services do not include it, so uninstalling the App, clearing its data or switching to a new phone leaves you with no data. To keep your data, create a backup in the App (More > Backup / Restore) and save it outside the App, for example in cloud storage. The App can remind you to back up regularly.

Backup files are intended to be encrypted using a password you choose. We do not receive or store that password and cannot recover it. A forgotten password, damaged file, incompatible version or technical failure may make a backup unusable. Files you export as CSV (More > Import / Export) are not encrypted: anyone who can open the file can read it.

You are responsible for protecting your device, login details, backup passwords and exported files, and for the security and availability of any location or service where you store or send a backup.

Security

Security features reduce risk but cannot guarantee absolute security. To the fullest extent permitted by law, we are not responsible for unauthorised access, loss or corruption caused by your device, credentials, chosen storage provider, third party, malware or circumstances outside our reasonable control.

Who is responsible and why we process data

852 Technologies LLC, based in Pennsylvania, United States, is responsible for the personal information described in this notice for which we decide the purposes. App stores, barcode data sources and external websites operate independently under their own privacy terms.

Where applicable law requires a legal basis, we process data to provide the features and purchases you request, to comply with legal duties, for our legitimate interests in securing, maintaining and improving the App and responding to you, and with your consent where required. Giving feedback or contact details is optional, but without contact details we may be unable to reply.

Sharing, sale and advertising

We disclose only the data needed to providers that support purchase management, app updates and diagnostics, barcode lookup, website hosting and delivery, feedback forms and aggregate analytics, and to the app stores you use. We do not sell personal information or share it for cross-context behavioural advertising. Itemity contains no third-party advertising and does not track you across other apps or websites, so "Do Not Track" and Global Privacy Control signals do not change how the App or our website works.

Retention and international processing

Data on your device stays until you delete it or the device or the App removes it. We keep support messages, optional feedback contact details and provider records only for the purposes described above, for as long as reasonably necessary for support, security and legal obligations, or until a valid deletion request applies. Providers keep the data they hold for the periods set by their own privacy terms.

Providers may process data outside your state or country, including in the United States. Where applicable law requires it, we rely on contracts and other appropriate safeguards for those transfers.

Your privacy rights

Depending on where you live (for example California, the European Economic Area, the United Kingdom or Hong Kong), you may have the right to ask what personal information we hold about you and for a copy of it, to have it corrected or deleted, to object to or restrict certain processing, to withdraw consent, and not to be treated unfavourably for using these rights. Email support@852technologies.com to make a request. We may need to verify your identity, and an authorised agent may act for you with your written permission.

We will respond within the time applicable law requires (generally 30 to 45 days) and tell you if we cannot fully honour a request, and why. If you disagree with our decision you may reply to ask us to review it. You may also complain to your local data-protection authority. Some data may have to be kept for legal, security or recordkeeping reasons.

For Hong Kong residents: giving us personal data is voluntary; the purposes of collection and the classes of recipients are described in this notice, and you may ask for access to and correction of your personal data at the address above.

Children

Itemity is a general-audience home-inventory tool and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact support@852technologies.com and we will delete it.

Availability, updates and changes to the App

We may add, remove, limit, modify, suspend or discontinue any feature or the App, and may release updates that are required for continued use. We do not guarantee uninterrupted availability, error-free operation, compatibility with every device or operating-system version, or continued support for any feature or third-party service. Purchased Itemity Pro features are also covered by the "Itemity Pro, purchases and free trial" section.

You are responsible for installing updates, maintaining a compatible device and operating system, and exporting or backing up your data before updates, device changes or discontinuation.

Intellectual property and feedback

The App, its software, design, text, graphics, logos, trademarks and other content are owned by or licensed to us and are protected by applicable intellectual-property laws. Third-party names, data and materials remain the property of their respective owners and may be subject to separate licences.

If you voluntarily provide ideas, suggestions or feedback about the App, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, modify and commercialise that feedback without restriction or payment, without identifying you unless you agree otherwise.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT, OUTPUTS AND THIRD-PARTY DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES, REPRESENTATIONS OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, SECURITY AND AVAILABILITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We make no promise about, and are not responsible for, the app stores, payment processors, barcode lookup services, update and diagnostics services or other third-party services you use with the App; they are provided by others under their own terms.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL LOSS, OR FOR LOSS OF DATA, PROFITS, REVENUE, SAVINGS, BUSINESS, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

THIS EXCLUSION INCLUDES LOSS OR DAMAGE ARISING FROM INABILITY TO USE THE APP; LOST OR CORRUPTED DATA OR BACKUPS; INACCURATE OR MISSED ALERTS; WASTED, MISSED OR DUPLICATE PURCHASES; SPOILED OR EXPIRED PRODUCTS; THIRD-PARTY DATA OR SERVICES; OR UNAUTHORISED ACCESS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR OTHERWISE, WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE APP THROUGH THE APP STORE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE FIRST CLAIM, LESS ANY REFUNDS AND TAXES. IF YOU PAID NOTHING IN THAT PERIOD, OUR TOTAL LIABILITY IS ZERO. MORE THAN ONE CLAIM DOES NOT INCREASE THIS LIMIT, AND IT APPLIES EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THIS LIMIT IS A MAXIMUM ONLY AND DOES NOT CREATE ANY ENTITLEMENT TO A REFUND OR COMPENSATION.

Your sole and exclusive remedy for dissatisfaction with the App is to stop using it and uninstall it and, for a paid Itemity Pro feature, to ask the app store for a refund under the store's policy. We do not provide refunds, credits or other compensation ourselves, except where mandatory law requires it. To the extent the law allows, any claim relating to the App or these Terms must be brought within one year after it arose.

These limits also protect our owners, affiliates, licensors and service providers, who may rely on them. They reflect an agreed allocation of risk and are reflected in the price of the App.

Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence where applicable law prohibits exclusion. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

Indemnity

To the extent permitted by law, you will indemnify and hold us harmless from third-party claims, losses, liabilities and reasonable costs arising from your unlawful use of the App, material breach of these Terms, or infringement of another person's rights. This does not require you to indemnify us for our own negligence, wilful misconduct or violation of law, and does not limit non-waivable consumer rights.

Termination

You may end this agreement at any time by stopping use and uninstalling the App. We may suspend or terminate the licence if you materially breach these Terms, if required by law or an app-store provider, or if we discontinue the App.

On termination, your right to use the App ends. Provisions that by their nature should survive—including intellectual property, disclaimers, liability limits, indemnity, governing law and general terms—will survive. Termination does not itself retrieve or preserve device-local data.

Changes to these Terms

We may update these Terms to reflect changes to the App, law, security or business practices. The effective date identifies the current version. Where reasonably practicable, we will provide notice in the App or through the distribution channel before material changes take effect.

Your continued use after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree, stop using and uninstall the App. We will seek additional consent where applicable law requires it, including for material changes to how personal information is used.

Governing law and disputes

These Terms and any dispute or claim relating to them or the App are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-laws rules, except to the extent mandatory law in your place of residence applies.

Subject to any non-waivable consumer right to use another forum, you and we submit to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Pennsylvania, United States, for any dispute arising out of or relating to these Terms or the App.

Before filing a claim, each party agrees to make a reasonable good-faith effort for 30 days to resolve the dispute informally after written notice, unless urgent injunctive relief or applicable law makes that impracticable.

App-store terms

If you obtained the App from Apple App Store or Google Play, these Terms are between you and us, not the store provider. We, not the store provider, are responsible for the App, support and claims relating to it, subject to these Terms and applicable law.

Your licence is also subject to the store's usage rules. You represent that you are not located in a country subject to a United States Government embargo and are not listed on a United States Government prohibited or restricted party list, to the extent required by the applicable store terms.

For an Apple-distributed version, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable app-store provisions against you upon your acceptance.

General terms

These Terms, together with any mandatory app-store terms, are the entire agreement between you and us concerning the App and replace prior discussions or understandings about it.

If any provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. A failure or delay in enforcing a provision is not a waiver.

You may not assign or transfer these Terms or your licence without our written consent. We may assign these Terms as part of a reorganisation, financing, sale of business or assets, or by operation of law, subject to applicable consumer law.

We are not liable for delay or failure caused by events beyond our reasonable control. Section headings are for convenience only and do not affect interpretation.

Language

Translations are provided for convenience. If an English version and a translated version are ambiguous, inconsistent or conflict, the English version controls, except where applicable law requires otherwise.
